1. Introduction
This Privacy Policy describes how Ortega Digital Inc., a Wyoming corporation ("Ortega Digital," "we," "us," or "our"), collects, uses, discloses, and protects information in connection with the Revenue Stack website, application process, diagnostic call, and Program (collectively, the "Site").
This Policy is directed primarily at visitors and applicants located in the United States. If you access the Site from outside the United States, you understand that your information will be transferred to and processed in the United States, which may have different data protection laws than your home country.
By using the Site or submitting an application, you agree to the collection and use of information as described in this Policy. If you do not agree, do not use the Site.
2. Information We Collect
2.1 Information You Provide Directly
When you use the Leak Calculator, apply to the Program, or book a call, we may collect:
Name
Email address
Phone number
Business website URL
Business information you provide in the application, including revenue range, new customer range, current monetization layers, implementation timing, decision-making authority, and any free-text notes you submit
The Leak Calculator on the Site accepts numeric inputs to model a revenue scenario for illustrative purposes. These calculator inputs are processed in your browser and are not transmitted to or stored by us unless you separately submit them as part of an application.
2.2 Information Collected Automatically
When you visit the Site, we and our third-party partners may automatically collect certain information through cookies, pixels, and similar tracking technologies, including:
Pages visited and actions taken on the Site
Device and browser information
Approximate location derived from IP address
Referral source, including which ad or link brought you to the Site
We use the following third-party tracking tools on the Site:
Meta Pixel, to measure and optimize advertising performance on Meta platforms.
Google tracking tags, to measure and optimize advertising performance on Google platforms.
Hyros, an attribution and tracking platform used to connect ad spend and traffic sources to applications and outcomes.
These tools may set cookies on your device and may share information about your visit with Meta, Google, and Hyros respectively, subject to each platform's own privacy policy.
2.3 Information From the Diagnostic Call
If you book a diagnostic call, the call may be conducted and recorded through our video meeting platform (for example, Google Meet) or, for calls conducted by phone, through our phone system provider (Aquos, powered by GoHighLevel), which may record and store call audio as part of its standard call-handling functionality.
We use call recordings and any associated transcripts for internal purposes, including preparing for the call, reviewing the conversation, training, and, with your separate permission where required, for marketing purposes such as testimonials. We will not use a recording for a purpose beyond internal review or marketing without your consent where consent is legally required.
3. How We Use Your Information
We use the information we collect to:
Evaluate and respond to your application
Schedule, conduct, and follow up on diagnostic calls
Communicate with you about the Program, by email, phone, or text message
Measure and improve the performance of our advertising and the Site
Deliver the Program to clients who are accepted, as described in the Program's Terms and Conditions
Comply with legal obligations and enforce our agreements
4. How We Share Your Information
We do not sell your personal information. We share information in the following circumstances:
Service providers. We use third-party platforms to operate the Site and Program, including GoHighLevel/Aquos (application forms, calendar booking, phone and SMS, and call recording), and, where applicable, video conferencing and note-taking tools used to record and transcribe diagnostic calls. These providers process information on our behalf and are not authorized to use it for their own independent purposes.
Advertising and attribution partners. Meta, Google, and Hyros may receive information about your visit and, where you have taken an action such as submitting an application, information that helps us and them measure which advertising led to that action, as described in Section 2.2.
Legal and safety. We may disclose information if required by law, subpoena, or legal process, or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
Business transfers. If Ortega Digital is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction, subject to this Policy or a successor policy.
5. Cookies and Tracking Technologies
The Site uses cookies and similar technologies, including those associated with the Meta Pixel, Google tracking tags, and Hyros, to operate the Site, remember your preferences, and measure advertising performance.
You can control cookies through your browser settings, including blocking or deleting cookies. Blocking certain cookies may affect the functionality of the Site, including your ability to complete the application form or use certain tracking-dependent features. Where required by law, we will request your consent before setting non-essential cookies.
6. Data Retention
We retain personal information for as long as necessary to operate the Site and the Program, respond to your inquiries, comply with our legal obligations, resolve disputes, and enforce our agreements. If you are accepted into the Program, information related to your engagement, including data used to measure the guarantee described in the Program's Terms and Conditions, is retained for the duration of the engagement and for a reasonable period afterward for record-keeping purposes.
If you are not accepted into the Program, or you withdraw your application, we retain your application information for a reasonable period for internal record-keeping, unless you request deletion as described in Section 8.
7. Data Security
We use reasonable administrative, technical, and organizational measures designed to protect the information we collect. No method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
8. Your Rights and Choices
8.1 General Rights
Depending on your location, you may have the right to request access to, correction of, or deletion of your personal information, or to object to or restrict certain processing. To make a request, contact us using the information in Section 11.
8.2 California Residents
If you are a California resident, you may have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), including the right to know what personal information we have collected about you, the right to request deletion of that information, the right to correct inaccurate information, and the right to opt out of the sale or sharing of personal information. We do not sell personal information. To the extent our use of advertising and attribution tools described in Section 2.2 constitutes "sharing" under the CCPA/CPRA, you may opt out by contacting us or by using your browser's cookie controls.
We will not discriminate against you for exercising any right under the CCPA/CPRA.
8.3 Marketing Communications and Text Messages
You may opt out of marketing emails at any time by using the unsubscribe link included in those emails. You may opt out of text messages at any time by replying STOP to any message you receive from us. Opting out of marketing communications will not affect transactional communications necessary to deliver the Program if you are an active client.
9. Children's Privacy
The Site is not directed at, and is not intended for use by, anyone under the age of 18. We do not knowingly collect personal information from individuals under 18. If we become aware that we have collected personal information from someone under 18, we will take steps to delete that information.
10. Changes to This Policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the updated Policy. If changes are material, we may provide additional notice where required by law.
